Export to Spain

The structure of fashion distribution for exporting to Spain

One of the major developments affecting the Spanish clothing industry is similar to that of several European countries, the slow decline of multi-brand retailers in favour of chains.
For the first time ever, chains have caught the independent stores up and have a 27% share of the clothing market. Multi-brand shops have seen their market share go from 43% in 1999 to just 26% in 2009. This change has had several consequences for Spanish industrialists who are faced with the erosion of their internal markets, chains sourcing stock in Asia and countries surrounding the Mediterranean. Many have them have disappeared (Source: Franck Delpal, IFM Paris point pays Espagne).

The increasing impact of important chains which includes the group Inditex (Zara) has made Spain an important link in the network via which high levels of merchandise travel. This is why a drastic dip in local manufacturers, Spanish exports reached record levels in 2010 (5.6 billion Euros) (Source Franck Delpal, IFM Paris point pays Espagne).

Precautionary measures for the B to B debts for those who are exporting in Spain

In addition to our credit insurance policy and for accounts linked to our online platform set up for clients, our debt recovery department will give you the following general advice: sending a formal notice is not governed by law and is not a prerequisite to beginning legal proceedings (Source: Guide Pratique du Recouvrement de créances by Martine Dickstein).
For precautionary measures, retention of title exists in Spain and is totally valid and legal under Spanish law.
Any seizing of goods from the debtor must be requested before the beginning of the proceedings. For our clients who export in Spain, we see that precautionary measures are difficult to apply in Spanish commercial law so ask our account receivables management department for information before trading in Spain.

We will carry out a detailed study on the traditional types of credit insurance in all countries, and our account receivable management and debt recovery departments will give you advice based on their experience in private commercial law in terms of debts in the country concerned.
